Terms of Service

These terms govern your use of TheWashCRM. By signing up, you agree to them.

Effective: May 2, 2026 (version 2026-05-02). This is the current version. Material changes will be communicated by email at least 30 days before taking effect.

1. Who we are

TheWashCRM (“we,” “us,” the “Service”) is software-as-a-service for car wash businesses, operated by Jared Parr, sole proprietor, in the United States. You can reach us at support@thewashcrm.com.

2. Who you are

You (“Customer,” “Operator”) are the business or individual signing up to use TheWashCRM to manage a car wash operation. You represent that you have the authority to bind the entity you sign up on behalf of. You must be at least 18 years old.

3. The Service

TheWashCRM provides a platform for car wash operators to take bookings, manage customers, run memberships, accept payments via Stripe Connect, and operate a public-facing booking site. Specific features depend on the plan tier you’re on (Starter, Growth, Pro); plan details are at thewashcrm.com/pricing.

We may change, add, or remove features. Material reductions to functionality on a paid plan will be announced at least 30 days in advance.

4. Subscription & payment

4.1 Trial

New signups receive a 14-day free trial. Your payment method is collected at checkout but not charged until the trial ends. You may cancel at any time before the trial ends without charge.

4.2 Recurring billing

After the trial, your subscription renews automatically each billing cycle (monthly or annual, as selected) at the price in effect when you signed up. You authorize us, via Stripe, to charge your payment method on file.

4.3 Failed payments

If a payment fails, Stripe automatically retries up to four times over approximately seven days. Your account remains active during retries. If retries don’t recover the payment:

4.4 Cancellation

You may cancel your subscription at any time from Settings → Account → Billing. Cancellation takes effect at the end of the current billing period. We do not refund partial periods.

4.5 Price changes

We may change subscription pricing for new signups at any time. Existing customers will receive at least 30 days’ notice before any price increase takes effect on their plan.

5. Customer payments & Stripe Connect

Payments your end customers make for car washes flow directly to your own Stripe account via Stripe Connect. We do not hold, custody, or have access to your customer payment funds. Stripe is a separate party with its own terms and fees that you agree to when you connect your Stripe account.

Refunds, chargebacks, and disputes from your end customers are your responsibility to handle in your Stripe dashboard. We may surface alerts to you when these events happen, but we do not respond on your behalf.

7. Your data

7.1 Ownership

You retain all rights to data you and your customers provide to the Service (booking records, customer profiles, content you upload). We claim no ownership over Customer Data.

7.2 Our use

You grant us a limited license to host, process, transmit, and display Customer Data solely as necessary to provide the Service to you. We may use aggregated, anonymized data to improve the Service. See our Privacy Policy for full details on data handling.

7.3 Export

You can export Customer Data as CSV from Settings → Account → Data export (Pro tier). On account termination, you have 90 days to export before data is deleted.

8. Our intellectual property

TheWashCRM software, design, and content are owned by us. We grant you a non-exclusive, non-transferable license to use the Service during your subscription. You may not copy, modify, or create derivative works of the Service.

9. Service availability

We aim for high availability but do not promise specific uptime guarantees on Starter or Growth plans. The Service is provided “as is” without warranties of any kind, express or implied. Maintenance windows, third-party outages (Stripe, Clerk, hosting providers), and force majeure events may cause downtime.

10. Liability

To the maximum extent permitted by law, our total liability to you arising out of or relating to the Service is limited to the amount you paid us in the 12 months immediately preceding the event giving rise to the claim. We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits, lost revenue, or business interruption.

Some jurisdictions don’t allow exclusion or limitation of certain damages, so portions of this section may not apply to you.

11. Indemnification

You agree to indemnify and hold us harmless from claims arising out of (a) your violation of these Terms, (b) your violation of any law or third-party right (including intellectual property, privacy, or consumer protection laws), or (c) Customer Data you upload to the Service.

12. Termination

Either party may terminate the agreement at any time. You can cancel via your dashboard. We may terminate or suspend your account if you materially breach these Terms, fail to pay, or engage in prohibited use. Upon termination, your data is preserved for 90 days for export, then deleted.

13. Changes to these Terms

We may amend these Terms by posting an updated version at this URL and bumping the version date at the top. Material changes will be emailed to your account’s contact email at least 30 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance.

14. Governing law & disputes

These Terms are governed by the laws of the State of [STATE], without regard to conflict-of-laws principles. Disputes will be resolved in the state or federal courts located in [COUNTY, STATE]. You and we waive the right to a jury trial and waive the right to participate in class actions arising out of or relating to the Service.
